Terms and conditions
I. PARTIES
These Website Terms & Conditions ("Agreement") are made, entered into, and agreed to by and between You ("Website User") and Enlace Legal, LLC ("Enlace Legal"). By using Enlace Legal’s website ("Website")Website User agrees to be bound by this Agreement.
II. ATTORNEY INTERNET SEARCH SERVICE
Enlace Legal is not a law firm or a provider of legal services and does not provide legal advice to any Website User.
Enlace Legal is an internet service that allows the Website User to search for an attorney who represents that they either: (a) speak Spanish; or (b) employ at least one staff member at their law firm who speaks Spanish ("Attorney”).
El Sitio Web permite al Usuario del Sitio Web buscar un Abogado por área de práctica y ubicación geográfica utilizando un sistema automatizado que proporciona simultáneamente: (a) al Usuario del Sitio Web la información de contacto de hasta tres Abogados (si un Abogado está registrado en Enlace Legal como proveedor de servicios legales en el área de práctica y ubicación geográfica que busca el Usuario del Sitio Web); y (b) al o a los abogados, la información de contacto del usuario del sitio web. Como se usa en este documento, el término "Website User’s Contact Information" refers to Website User’s: (a) name; (b) email address; (c) telephone number; and (d) the description of the Website User’s legal issue, as entered by the Website User on the Website.
If an Attorney is not registered with Enlace Legal as a provider of legal services in the practice area and geographic location for which the Website User searches, Enlace Legal will use reasonable efforts to locate an Attorney in the practice area and geographic location for which the Website User searches and shall share the Website User’s Contact Information with the Attorney.
Whether to retain an Attorney is solely within the discretion of the Website User. The Website User agrees to exercise such discretion, if at all, only after conducting their own research on such Attorney, and without relying on the information obtained through the Website.
Enlace Legal does not assure or guaranty that the Website User will locate an Attorney through the Website. If a Website User does locate an Attorney through the Website, whether an attorney-client relationship is formed and the terms of any such attorney-client relationship are solely between the Website User and the Attorney. Enlace Legal does not dictate, suggest, or otherwise take a position on the formation or terms of any such attorney-client relationship. Moreover, Enlace Legal will not become involved in the provision of legal services by an Attorney, and is not responsible for any aspect of the provision of legal services by an Attorney.
III. DISCLAIMER OF ATTORNEY-CLIENT RELATIONSHIP
Website User acknowledges and agrees that: (a) no attorney-client relationship is being formed by virtue of this Agreement between the Website User and Enlace Legal; (b) no attorney-client relationship shall be formed between the Website User and Enlace Legal by virtue of the Website User’s use of the Website; (c) no attorney-client relationship shall ever exist between the Website User and Enlace Legal; (d) Enlace Legal is not offering the Website User legal advice, legal recommendations, or legal counseling under any circumstance; and (e) Website User’s use of the Website does not constitute the provision of legal services, legal advice, legal recommendations, or legal counseling under any circumstance.
IV. CONSENT TO DISCLOSURE OF WEBSITE USER CONTACT INFORMATION
Website User consents to Enlace Legal’s disclosure of their Website User Contact Information to any Attorney: (a) registered as an Attorney Member with Enlace Legal; or (b) which Enlace Legal contacts as part of their efforts to locate an Attorney for the Website User. As used herein, the termAttorney Memberrefers to an Attorney who has executed an agreement with Enlace Legal for the provision of marketing services in exchange for a marketing fee paid by the Attorney Member.
V. PUBLICIDAD PAGADA POR MIEMBROS ABOGADOS
Attorney Members pay Enlace Legal an advertising fee in exchange for being part of the network of Attorneys included in Enlace Legal’s Website.
VI. CONSENT TO CONTACT BY ATTORNEYS
Website User consents and agrees to immediately being contacted by any Attorney with whom Enlace Legal shares the Website User’s Website User Contact Information, without the necessity of any further verbal or written consent from the Website User and without regard to whether the Attorney is an Attorney Member.
VII. DESCARGOS DE RESPONSABILIDAD
Enlace Legal makes no representation, guarantee, or warranty (express or implied) as to any of the following, each of which are expressly disclaimed by Enlace Legal:
- the legal ability, competence, or quality of representation which may be provided by any Attorney, law firm, or legal service provider with which the Website User makes contact by virtue of its interaction with the Website;
- the language fluency or proficiency of any Attorney, law firm, or legal service provider with which the Website User makes contact by virtue of its interaction with the Website.
- any Attorney, law firm, or legal service provider’s legal abilities with respect to any practice area or geographic location;
- si algún abogado, bufete de abogados o proveedor de servicios legales actualmente tiene licencia, está autorizado o goza de buena reputación para ejercer la abogacía en cualquier estado, jurisdicción, tribunal o ubicación geográfica en particular;
- the accuracy or veracity of any information listed on the Website, including but not limited to, any information included in any Attorney, law firm, or legal service provider’s biographical or contact information or qualifications;
- the accuracy or veracity of any information communicated by any Attorney, law firm, or legal service provider independent of the Website;
- the accuracy, veracity, competence, or legality of any legal advice provided by any Attorney, law firm, or legal service provider with which the Website User makes contact by virtue of its interaction with the Website.
- the accuracy or veracity of any information provided by any Website User;
- the integrity of any Attorney, law firm, or legal service provider with which the Website User makes contact by virtue of its interaction with the Website;
- any description or representation of specialization by any Attorney, law firm, or legal service provider with which the Website User makes contact by virtue of its interaction with the Website;
Website User acknowledges and agrees that Enlace Legal bears no liability or responsibility with respect to any of the matters expressly disclaimed by Enlace Legal herein.
VIII. ACUERDO PARA VERIFICAR LA INFORMACIÓN DE FORMA INDEPENDIENTE
When considering whether to hire, retain, or engage any Attorney, law firm, or legal service provider, Website User agrees to independently verify the contact information, biographical information, and qualifications of any Attorney, law firm, or legal service provider with whom it makes contact by virtue of its interaction with the Website. Website User further agrees to independently verify the Attorney, law firm, or legal service provider’s standing with the bar or regulatory authority which the Attorney, law firm, or legal service provider represents claims has authorized it to practice law or otherwise provide legal services.
IX. CONFIDENTIALITY
Enlace Legal makes every effort to maintain the confidentiality of any information submitted by Website Users to the Website. However, because Enlace Legal cannot control the conduct of others, we cannot guarantee that this information will remain confidential. Please use caution in deciding what information to share on the Website. Do not make any confessions or admissions. Do not provide any highly personal, sensitive, or incriminating information. Enlace Legal is not responsible for the release or improper use of such information.
Website User agrees that attorneys contacted by Website User through the Website may report to Enlace Legal on whether their services were engaged by the Website User.
X. INDEMNIZACIÓN
Website User agrees that Enlace Legal is not responsible for any harm that this service may cause. Website User agrees to indemnify, defend, and hold Enlace Legal harmless from and against any and all liability and costs incurred in connection with any loss, liability, claim, demand, damage, and expenses arising from or in connection with the contents or use of the Website. Website User agrees that this defense and indemnity shall also apply to any breach by the User of the Agreement or the foregoing representations, warranties and covenants. Website User further agrees that this defense and indemnity shall include without limitation attorney fees and costs. Website User also agrees that this defense and indemnity shall apply to Enlace Legal, its affiliates, directors, officers and employees. Enlace Legal reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by the User and the User shall not in any event settle any matter without the written consent of Enlace Legal.
XI. COMMUNICATIONS AND OTHER DATA
Enlace Legal is not responsible for any loss of data resulting from accidental or deliberate deletion, network or system outages, file corruption, or any other reasons.
XII. MODIFICATIONS TO TERMS OF SERVICE
Enlace Legal may change this Agreement at any time. Website User will be notified of the change and will be responsible for promptly reading and complying with the new terms and conditions. Continued use of the service will indicate acceptance of the new terms and conditions.
XIII. MODIFICATIONS TO WEBSITE
Enlace Legal reserves the right to modify or discontinue, temporarily or permanently, the Website with or without notice to Website User. Website User agrees that Enlace Legal shall not be liable to Website User or any third party for any modification or discontinuance of the Website. Website User acknowledges and agrees that any termination of the Website under any provision of this Agreement may be effected without prior notice, and acknowledges and agrees that Enlace Legal may immediately delete data and files in Website User's account and bar any further access to such files or the Website.
XIV. LIMITATION OF LIABILITY
Website User agrees that Enlace Legal shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or the inability to use the Website or resulting from any goods or services purchased or obtained or messages received or transactions entered into through or from the Website or resulting from unauthorized access to or alteration of user's transmissions or data, including, but not limited to damages for loss of profits, use, data or other intangibles, even if Enlace Legal has been advised of the possibility of such damages. The user further agrees that Enlace Legal shall not be liable for any damages arising from interruption, suspension or termination of the Website, including, but not limited to, direct, indirect, incidental, special, consequential or exemplary damages, whether such interruption, suspension or termination was justified or not, negligent or intentional, inadvertent or advertent.
XV. ARBITRAJE
Any dispute, claim or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Bexar County, Texas before one arbitrator. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures pursuant to JAMS' Streamlined Arbitration Rules and Procedures. Judgment on the Award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. This arbitration clause does not prohibit either Enlace Legal or the User from seeking to have the arbitration dismissed or judicially terminated on the basis the claims in arbitration action fail to provide a legal basis upon which a claim for relief may be granted. Any motion or action to dismiss must be filed in a court of general jurisdiction within Bexar County, Texas.
XVI. GENERAL
Users can reach the Website from multiple states of the United States and around the world. Nevertheless, the Agreement and the relationship between the Website User and Enlace Legal shall be governed by the laws of the State of Texas without regard to its conflict of law provisions.
If Enlace Legal fails to exercise or enforce any right or provision of this Agreement, that failure shall not be used to prove that Enlace Legal has waived the right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and that the other provisions of the Agreement remain in full force and effect. Website User agrees that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Website or the Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.
